The Mighty Mouth Program

Please read these Terms and Conditions (“Terms”) carefully before purchasing or using the Mighty Mouth Program (the “Program”), offered by O'Brien Wellness LLC (“we,” “us,” or “our”). By purchasing, accessing, or using the Program, you (“you,” “the parent,” or “the user”) agree to be bound by these Terms. If you do not agree, do not purchase or use the Program.

1. About the Program

The Mighty Mouth Program is an 8-week, play-based digital home program of general educational activities designed to support oral motor foundations for breathing, sleeping, and eating in children ages 2–4. The Program is delivered entirely as digital content, including videos, printable materials, and activity guides.

2. Not a Therapeutic Relationship; Not a Substitute for Professional Care

The Program is general educational content only. It does not constitute occupational therapy, myofunctional therapy, feeding therapy, medical care, or any other professional service, and it does not create a therapist–client, provider–patient, or any other professional or therapeutic relationship between you (or your child) and O'Brien Wellness LLC or its owner.

The Program is a supportive starting point. It is not a replacement for, and should not be used in place of, a professional evaluation or one-on-one therapy provided by a qualified professional. The activities are generic and are not individualized treatment for your child.

Always discuss any concerns you have about your child — including concerns about breathing, sleep, feeding, speech, or development — with your child’s primary care provider or another qualified healthcare professional. If you notice any red flags described within the Program, pause and seek a professional assessment.

3. Parental Responsibility and Judgment

You are the parent or legal guardian of the child participating in the Program, and you are solely responsible for that child’s care and supervision. You know your child and your circumstances best.

  • Always use your own best judgment regarding your child, your family, and your unique circumstances when deciding whether and how to use any tool, activity, food, or exercise in the Program.

  • Supervise your child at all times during any Program activity.

  • Do not proceed with any activity that seems inappropriate, unsafe, or beyond your child’s current ability, and stop immediately if your child shows any sign of distress.

4. Assumption of Risk

Participation in the Program involves activities and foods that carry inherent risks. By using the Program, you knowingly and voluntarily assume all risk associated with your and your child’s use of the tools, foods, activities, and exercises described in the Program, including but not limited to:

  • Choking, gagging, aspiration, or other airway or feeding-related risks associated with food activities and oral motor activities.

  • Food allergies, sensitivities, or adverse reactions. You are responsible for knowing your child’s allergies and dietary restrictions and for substituting or omitting any food that is not safe or appropriate for your child.

  • Injury or discomfort arising from movement, reflex-integration, or other physical activities.

You are responsible for confirming that every activity and food is age-appropriate and safe for your specific child before use. When in doubt, consult your child’s primary care provider first.

5. Payment and Refund Policy

All sales are final. Due to the digital nature of the Program and the immediate access provided upon purchase, no refunds, returns, exchanges, or cancellations will be offered for any reason once purchase is complete.

By completing your purchase, you acknowledge that you are buying digital content, that access is granted immediately, and that you waive any right to a refund.

6. License and Acceptable Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and use the Program materials for your own personal, non-commercial, family use.

  • You may not copy, reproduce, resell, redistribute, share, sublicense, or publicly display the Program or any of its content.

  • You may not share your login credentials or access with anyone outside your household.

  • All content, including videos, printables, text, graphics, branding, and materials, is the intellectual property of O'Brien Wellness LLC and is protected by applicable copyright and other laws.

7. No Guarantee of Results

Every child is different. We make no representations, warranties, or guarantees regarding any specific outcome, result, or improvement from using the Program. Results, if any, will vary based on individual circumstances outside our control.

8. Limitation of Liability

To the fullest extent permitted by law, O'Brien Wellness LLC, its owner, and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss or injury, arising out of or relating to your or your child’s access to or use of the Program, the activities, tools, or foods described within it, or your reliance on any information provided. Your sole and exclusive remedy is to stop using the Program.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless O'Brien Wellness LLC and its owner from any claims, damages, losses, liabilities, and expenses arising out of your or your child’s use of the Program or your breach of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Continued use of the Program after any update constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New York State.
